XXXIV.
However, it is certain law that this is waived for certain persons, such as those absent in another province, or those hindered by illness, old age, or another defect of nature; or those who excel in dignity and office in the city. These are not compelled to come to the judge, but the oath is sent to them if they are in the same territory, so that they may swear at home, with the ministers of the judge present, who record in the acts whether the oath was taken, referred, or refused. If, however, they live in another province, the matter is to be expedited by the judge of that place.
XXXV.
Let it be placed as a concluding point: that for perjury committed by swearing through God, the civil law establishes as punishment only divine vengeance and retribution.
