Provided the fief is deferred equally to those who are of the same stock and equal degree.
XXI.
But when they exist in an unequal degree, they succeed unequally by the right of representation.

Provided they are admitted to the succession by right. For only those have the right to succeed who are legitimate and capable of military duties.
XXIII.
Therefore, those who cannot stand in the lord's court or fulfill the place of a vassal are excluded from the succession and the title of son.
XXIV.
For this reason, the mute, the deaf, and the blind are not suitable if the defect is incurable, perpetual, and by nature itself. However, only as much is given to them as is sufficient for sustaining life.
XXV.
But when the defect is not perpetual, and not by nature itself, it is fairer not to impede the succession.
XXVI.
And natural illegitimate children are not admitted, even if they later become legitimate, unless it is by a subsequent marriage.
XXVII.
But whether a person legitimized for this very purpose by the Emperor can succeed, is doubted.
